Save Your Kitchen 2020 Rules

ELIGIBILITY REQUIREMENTS:

The school or district designated as the entrant’s employer on a winning entry will be deemed the Winner and will be awarded the prize, not the individual participant who submitted the winning entry. The 2020 Save Your Kitchen Promotion ("Promotion") is a trade promotion open to legal residents of the 50 United States and the District of Columbia, who are at least 18 years of age or of the age of majority in their state of residence, and who are K-12 foodservice employees at the time of entry. Employees, contractors, directors and officers of Hobart, Traulsen and Baxter, their parent, subsidiaries and affiliated companies, and the advertising, fulfillment, legal, administrative and promotion agencies involved in the Promotion (collectively, "Promotion Parties"), and the immediate family members of each such person and those living in the same household of each such person, are not eligible to enter or win a prize. Promotion subject to all applicable federal, state and local laws and regulations. Sponsored by Traulsen, 4401 Blue Mound Rd., Fort Worth, TX 76106 (“Sponsor”).

PROMOTION PERIOD:

Promotion begins February 6, 2020 at 12:00 am and ends March 6, 2020 at 11:59 pm. Entries received prior to or after the Promotion Period will be disqualified.

TO ENTER:

Entry by online only. To enter online, visit the website at www.saveyourkitchen.com during the Promotion Period and enter the relevant information into the entry form. By participating, entrants agree to abide by and be bound by these Official Rules and the Sponsor's and administrator's decisions. Entrants can enter online and only one (1) entry per person will be accepted, however there are no limits on the number of entries per organization during the Promotion Period. Only one (1) winner per organization will be allowed. Entrants may be subject to rules imposed by their employers relative to their participation in trade promotions and may require permission from their employer to enter and win. Entrants should check with their employer for any relevant policies. By entering, participant represents that they have the permission and/or consent of their employer to enter the Promotion. Entries that are deemed by the Sponsor, in its sole discretion, to be in violation of these Official Rules or to be otherwise inappropriate will be rejected and will not be eligible to participate in the Promotion. Entrant acknowledges and agrees that such decisions of Sponsor are final and binding. Once submitted, entries will become the property of Sponsor and will not be returned. Entries cannot be changed, altered or modified, once submitted.

DRAWING, ODDS OF WINNING AND PRIZE:

Approximately five (5) business days after the close of the Promotion Period, a representative of Sponsor will conduct a random drawing from all eligible entries received. Odds of winning depend on the number of valid, eligible entries received.

1 winner will be randomly selected to win their choice of: (1) One-Section Traulsen Pass-Thru Refrigerator, (1) One-Section Traulsen Reach-In Refrigerator, (1) One-Section Traulsen Reach-In Freezer, or (1) 8-Crate Traulsen Milk Cooler; selection to be fitted to facility's size (ARV: up to $14,000 MAP), and their choice of (1) HCC34 Hobart Food Processor, (1) EDGEl3A-11 Hobart Slicer, or (1) Limited Edition (red) HL200 Hobart Mixer to be fitted to the facility 's size (ARV: up to $7,000 MAP). Other restrictions may apply. Prizes are nontransferable. All federal, state, and/or local taxes are the sole responsibility of the Winning facility

WINNER NOTIFICATIONS AND PRIZE CLAIMS:

The selected potential winners are subject to verification, including verification that potential winners have each complied with his/her employer policies regarding entry and receipt of a prize for a trade promotion. Potential winners will be contacted and will have fourteen (14) days from the date of initial notification to confirm receipt of notification. At that time, each Winning facility and corresponding entrant will be provided with an affidavit of eligibility/liability and publicity release ("Release") that must be executed and returned within fourteen (14) days of notification, before any prize will be awarded. For avoidance of doubt, the school or district that is designated as the entrant’s employer on each winning entry is the Winner and will be awarded the prize, not the individual participant who submitted the winning entry. Sponsor is not responsible for any incorrect or changed contact information of entrants. If a potential Winner is found not to be eligible or not in compliance with these Official Rules, if prize notification or prize is unclaimed or returned as undeliverable after allowed time, or if prize is rejected, the potential Winner will be disqualified, and the prize will be forfeited and an alternate winner/facility will be selected from the remaining eligible entries. All prizes will be awarded. No cash or other substitution of prize is permitted, except that if the prize, or any portion thereof, cannot be awarded for any reason. Sponsor reserves the right to substitute the prize with another prize of equal or greater value. Allow four (4) to six (6) weeks for shipment of prize after verification.

GENERAL CONDITIONS:

ANY ATTEMPT TO UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON OR COMPANY TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION. If the Promotion is not capable of running as planned for any reason, including without limitation, due to printing errors, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, Sponsor reserves the right, at its sole discretion, to disqualify any individual who is responsible or who tampers with the entry process, and/or to cancel, modify or terminate the Promotion. In the event of cancellation or modification, Sponsor will award the prize in a random manner to be determined by Sponsor. This Promotion is offered only in the United States and is governed by the laws of the state of Texas, without giving effect to any choice of law or conflict of law rules, and entrants consent to jurisdiction and venue in, and agree that all claims and disputes must be resolved in, the appropriate federal, state or local court located in the state of Texas. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. If any provision of these Official Rules is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced. Except as otherwise contemplated in these rules or in any publicity release, information collected by Sponsor in connection with this Promotion will be used by Sponsor in accordance with the online privacy policy posted at https://www.traulsen.com/notices-traulsen

LIMITATIONS OF LIABILITY AND RELEASE:

No liability or responsibility is assumed by Sponsor resulting from user's participation in, attempt to participate in, or download of any information in connection with participating in the Promotion. No responsibility or liability is assumed by Sponsor for technical problems or technical malfunction, including, without limitation, those arising in connection with any occurrences that may affect the operation of the Promotion. Sponsor is not responsible for any typographical errors in the announcement of the prize or these Official Rules, or any inaccurate or incorrect information related to the Promotion. Sponsor is not responsible for any personal injury or property damage or any other losses of any kind that may be sustained resulting from participation in the Promotion, or any other loss related to user's participation in the Promotion or receipt of any prize. As a condition of entering, entrants agree (and agree to confirm in writing): (a) to release Sponsor from any and all liability, loss or damage incurred with respect to entrant's participation in the Promotion and the awarding, receipt, possession and/or use or misuse of any prize, including any traveling related thereto; (b) to release and to indemnify and hold harmless Sponsor from any and all liability, loss or damage incurred with respect to violation of intellectual property or personal rights (such as, but not limited to, copyright, patent, trade name/trademark, and/or rights of privacy or publicity or portrayal in a false light) due in whole or in part to entrant's entry or participation in the Promotion; (c) under no circumstances will entrant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expenses; (d) all causes of action arising out of or connected with this Promotion, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (e) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, excluding attorneys' fees and court costs. Except where prohibited by law, by entering the Promotion or accepting a prize, each entrant and winning facility grants permission for Sponsor and those acting under its authority to use his or her name and address (city and state), photograph, voice and/or likeness, for advertising and/or publicity purposes, in any and all media now known or hereinafter invented without territorial or time limitations and without further notice to and without additional compensation.
